Terms and Conditions — Bicycle and Equipment Rental

1. 01

   The rental is entered into between FeelSãoMiguel – Hotelaria Lda., Tax ID 518 916 502, and the customer identified on the rental form.

2. 02

   The customer declares receipt of the equipment in good working condition and undertakes to return it in the same condition, except for normal wear and tear.

3. 03

   The rental period begins upon delivery of the equipment and ends upon its return to FeelAzores staff, within business hours. Return of the equipment after the end of the contracted rental period will result in charges for the corresponding additional period, according to the current price list.

4. 04

   The customer is responsible for the equipment throughout the entire rental period, including loss, theft, or damage caused by improper, negligent, or unauthorized use contrary to the instructions provided.

5. 05

   In case of loss, theft, or total destruction of the equipment, the customer will be liable for its replacement value. In case of partial damage, the customer will be liable for repair costs. For reference regarding the commercial value of the equipment (RRP), bicycles fall into the following categories: MTB / Gravel — RRP between €1,100 and €1,700 E-City Bike — RRP €3,300 Gravel Carbon / Road Carbon / E-Gravel / E-MTB — RRP between €3,600 and €5,600 Junior Bikes — RRP between €400 and €650

   Any malfunction or technical problem must be reported immediately to FeelAzores. Repairs by third parties are not permitted without prior authorization.

7. 07

   The equipment must be used prudently, in accordance with current legislation and only for its intended purpose.

8. 08

   The equipment may not be transferred or subleased to third parties without prior authorization from FeelAzores, except in the case of operators, partners, or duly authorized entities.

9. 09

   FeelAzores reserves the right to refuse rentals to persons under the influence of alcohol or substances, or who do not present adequate conditions for safe use of the equipment.

10. 10

    Use of equipment by minors requires authorization and responsibility from their legal guardian or authorized adult.

11. 11

    Payments made are non-refundable for early return or partial use of the contracted period.

12. 12

    The customer acknowledges that the use of bicycles and sports equipment involves risk of accident or injury, assuming responsibility for its use.

13. 13

    Personal data collected will be used exclusively for rental management and compliance with legal obligations, in accordance with applicable legislation.

14. 14

    For any dispute, the district of the Azores has jurisdiction, with express waiver of any other.
